Overview

Job Summary

This position is located in the Department of Motor Vehicles (DMV), Adjudication Services Administration. In addition to typical DMV functions, DC DMV is also required to provide administrative hearings relative to challenges to pedestrian, parking, photo enforcement and traffic citations issued in the District of Columbia (DC). The Department reviews 300,000 cases a year which may be addressed by a Hearing Examiner at a formal in-person or virtual hearing or via its mail adjudication program where ticket challenges are submitted in writing or submitted on-line.

Cases typically involve hearings that accord due process subject to the District s Administrative Procedure Act and the Traffic Adjudication Act. The incumbent of this position serves as a Hearing Examiner responsible for conducting hearings on a full range of challenges that come before DMV.

Duties And Responsibilities
  • Conducts administrative hearings relating to the issuance of pedestrian, parking, and minor moving violations including citations issued by photo enforcement technology.
  • Issues orders of revocation of driver licenses for serious traffic offenses such as driving while intoxicated (DWI), driving under the influence (DUI) and operating while impaired (OWI).
  • Makes determinations that impact driver privileges to operate motor vehicles in DC and often impact drivers  employment options such as drivers licensed to operate commercial vehicles.
  • Administrative proceedings include adjudication of mail and online submissions as well as in-person and virtual hearings.
  • Reviews case records and conducts in-person and virtual hearings in an orderly and impartial manner.
  • Determines credibility of witnesses, evaluates evidence, and applies relevant rules, regulations and court decisions.
  • Prepares concise written statements and findings of facts, conclusions of law and appropriate orders.
  • Answers correspondence relating to matters under the jurisdiction of DMV.
  • Determines outcomes of motions to vacate judgment for failure to appear and requests for reconsideration.
  • Evaluates and decides procedural questions pertaining first to parties involved, consolidation of issues, notice, prima facie case issues and motions; and secondly, the relevance of evidence, hearsay, burden of proof and presumption, written evidence and cross-examination.
  • During hearings, acts with the legal expertise needed to effectively cross-examine respondents, witnesses and police officers to elicit facts necessary to render fair decisions.
  • The questioning of all parties must be carried out in a fair and evenhanded manner.
  • Guides course of each hearing to produce a clear, concise and relevant record.
  • Allows each claimant and witness a reasonable amount of time to present arguments and, at the same time, conducts proceedings in a manner that affords participants efficient hearings and impartial decisions.
  • Renders a decision based on fact-finding and conclusions of law.
Qualifications And Education

Specialized experience is experience which is directly related to the position which has equipped the individual with the knowledge, skills, and abilities to successfully perform the duties of the position. To be creditable, the incumbent must possess at least one (1) year of specialized experience equivalent to the next lower grade level in the normal line of progression.

License And Certification

The work is sedentary in nature, however; there may be some walking, standing, bending, and carrying of light objects.
