Assistant Attorney General - Antitrust and Data Privacy

The Utah Attorney General has an immediate opening for a full-time attorney to serve as an Assistant Attorney General in the Antitrust & Data Privacy Division. This position will focus primarily on data privacy and data breach enforcement, while assisting with antitrust work as needed. We are committed to serving the public, and we do this by working collaboratively with other state and federal partners in affirmative civil litigation.

The work includes investigation, negotiation, and litigation in state and federal courts.

Our team of four line attorneys and staff, led by the Division Director, has been on the front lines of litigation against large technology companies like Google and Meta. The Antitrust Team continues to litigate several major cases against Live Nation, Agri Stats, and many generic drug manufacturers. We also lead multistate investigations and actions against companies to protect consumer data.

For example, Utah was a leader in protecting our citizens’ genetic information when 23andMe suffered a data breach and again after it filed bankruptcy last year.

The Division is at the cutting edge of the national discussion about cybersecurity, consumer data privacy rights, artificial intelligence, and related topics like child online safety and privacy. Utah is a leader in developing and instituting data privacy protections for consumers, and the team is responsible for enforcing the Utah Protection of Personal Information Act (UPPIA), the Utah Consumer Privacy Act (UCPA), the Genetic Information Privacy Act (GIPA), the Government Data Privacy Act (GDPA), and more.

The ideal candidate will have experience with data breach and data privacy law, as well as antitrust and competition law. The candidate will also be familiar with the dynamics of multistate enforcement actions or similar multi‑party cases in the private sector. The job will involve navigating numerous complex civil investigations and litigation matters, primarily enforcing the UPPIA, UCPA, GIPA, GDPA, and HIPAA.

A candidate should be able to manage a caseload from initial complaint to investigation, litigation, trial, and appeal. In addition to working with many other state attorneys general, the Federal Trade Commission, and the U.S. Department of Justice, our team also advises and helps develop state legislation and policies.

We intend to fill this position with an attorney who has three or more years of civil litigation experience, including experience litigating a busy caseload in federal and state court. Membership in the Utah State Bar in good standing is required before completing probation, and membership in good standing in the bar of a state of the United States is required for probationary employment.

The position is primarily in‑office in Salt Lake City, Utah.

Responsibilities
  • Assist and collaborate with teammates and assign and supervise staff on a case‑by‑case basis.
  • Conduct all levels of civil litigation from initial intake, through investigation, pretrial, pleadings, law and motion, expert and fact discovery, trial, appeal, and post‑judgment.
  • Maintain an active caseload with minimal supervision.
  • Coordinate with public information officer as needed.
  • Build collaborative relationships with other state and federal enforcers.
  • Litigate high‑profile and complex cases.
  • Negotiate resolution of complex, multi‑party disputes.
  • Communicate, write, and listen well.
  • Draft legal briefs, contracts, and memoranda.
  • Present on topics at conferences and panels.
  • Learn new skills and adopt new technologies.
  • Travel to various events and courts in and outside of Utah.
  • Develop cases from initial complaints or inquiries.
  • Develop, edit, and consult on legislation over antitrust, competition and data privacy.
  • Additional factors that may be considered would be a formal education in economics, data privacy, or computer science, CIPP/US certification, or current work towards those goals.
Qualifications
  • Strong knowledge of general antitrust and competition laws, federal and state data privacy laws, and other related areas of law.
