Job SummaryThe Litigation Claim Representative is responsible for the day-to-day management of litigated claims on a dedicated client account. Reporting to the Litigation Manager, this role focuses on handling property damage, small claims court matters, and moderate bodily injury claims while partnering closely with the client’s Risk Department, internal legal teams, and outside defense counsel.
This is a true litigation handling role requiring sound judgment, strong negotiation skills, and the ability to independently manage complex files while maintaining cost control and compliance.
ResponsibilitiesWhen we hire litigation professionals at CCMSI, we seek adjusters who understand the human and financial impact of litigated claims, take ownership from first filing through resolution, and apply strong judgment to navigate legal complexity and risk.
- Investigate, evaluate, negotiate, and resolve litigated claims in accordance with client guidelines, corporate standards, and applicable laws
- Manage all aspects of litigation, including coordination with defense counsel, development of litigation strategy, and oversight of legal expenses
- Partner with the client’s Risk Department, internal legal teams, and outside counsel to drive timely and effective claim resolution
- Consult with and assist local divisions or general managers on Small Claims Court matters when defense counsel is not involved
- Establish, monitor, and adjust loss reserves and legal budgets within assigned authority
- Submit settlement and reserve recommendations for claims exceeding authority levels
- Maintain well-organized, thoroughly documented claim files demonstrating independent judgment and litigation expertise
- Participate in monthly claim reviews, meetings, and calls with clients and counsel
- Attend and actively participate in mediations, arbitrations, and settlement conferences as required
- Ensure settlements are issued accurately and timely, including proper execution of closing documentation
- Maintain full compliance with all state, statutory, regulatory, company, and client-specific claim handling requirements
- Acquire and maintain required adjuster licenses and complete all continuing education requirements
- 10+ years of multi-line claim adjusting experience with a strong emphasis on litigated claims
- Demonstrated experience managing litigation strategy and working directly with defense counsel
- Strong negotiation, analytical, and decision-making skills
- Proficiency with Microsoft Office (Word, Excel, Outlook)
- Arizona Adjuster License or ability to obtain within 60 days of hire
- Bachelor’s degree
- Prior experience handling litigated claims on a dedicated client account
- Familiarity with cost containment strategies and legal budget oversight
- Bilingual (Spanish) proficiency — highly valued for communicating with claimants, employers, or vendors, but not required.
