Senior Attorney – Employment (Berliner Cohen, LLP)

Berliner Cohen has immediate openings in the Employment Department for a Senior Attorney with a minimum of 5+ years of labor law and employment litigation experience. The position may be for Senior Attorney or Of Counsel, depending on experience and background, and is located in the San Jose or Modesto office.

Responsibilities:

• Work independently and manage cases from beginning to end with minimal direction.
• Take depositions, handle hearings, and act as lead counsel on cases.
• Advise clients on wage & hour laws, wage & hour litigation, class actions, employment discrimination, and wrongful termination matters in California state and federal courts.
• Respond to administrative charges and manage pre‑litigation disputes.
• Develop policies, deliver compliance training, and ensure familiarity with wage laws, leave (FMLA, CFRA, ADA, FLSA, Ca Labor Codes).

Qualifications:

• Minimum 5+ years of labor law and employment litigation experience; no book of business required but beneficial.
• Strong academic background with proven performance and measurable results.
• Exceptional communication, analytical, and writing skills.
• Ability to travel for depositions and court appearances.
• Hybrid work considered for the right candidate.

Salary starts at $210,000, with actual compensation dependent on qualifications and experience.
