PositionPurpose
Provide litigation management support to the organization as a whole.
Essential Job FunctionsThe incumbent must be able to perform the following duties.
Litigation Management- Manage the intake of all litigation, arbitration, and legal disputes, including by processing, reviewing, and responding to discovery and subpoenas.
- Manage the company s process and procedures for legal responses to subpoenas and documents requests.
- Maintain ownership and control over legal deadlines in employment and commercial litigation matters.
- Coordinate with internal and external counsel regarding all litigation matters.
- Prepare regular reports to monitor ongoing litigation, keeping all stakeholders informed of developments and potential impacts.
- Provide consultation and expert advice to management on areas of litigation.
- Act as the organization s subject matter expert for its Records Management Policy and data retention practices, and guide enterprise-wide compliance with the Records Management Policy.
- Review and update the Policy regularly to comply with applicable law.
- Oversee the legal holds process to ensure compliance with the Policy, and preservation of all corporate litigation records.
- Manage litigation recordkeeping systems, ensuring accurate records of litigation-related activities.
- Develop, implement, and manage company-wide and e-discovery programs and protocols in compliance with U.S. and global ESI and privacy requirements.
Partner with the attorneys regarding document requests, including subpoenas and discovery requests, and covering collection of electronic documents, reports and other relevant evidence.
Manage the email archival system; identify relevant custodians and data sources; issue legal notices and conduct custodial interviews; ensure compliance with all applicable rules and regulations regarding same.
Manage preservation of documents in connection with the legal hold process utilizing Office 365 Security and Compliance Center, Exterro and other business applications, including ESI, hard copy documents, and non-custodial data source; partner with IT, stores and other business units regarding same.
Independently prepares litigation holds for attorney review, using information from the case/matter.
Oversee the end-to-end electronic discovery. Has authority to make modifications to the system to improve the process.
Act as liaison between outside counsel and internal clients, including scheduling interviews and gathering information for discovery responses and subpoena requests.
Draft or manage drafting of cease & desist communications.
Update, track and maintain legal matters utilizing the company case management platform, Legal Tracker.
Conduct legal and factual research and data compilation.
Examines and evaluates information regarding case/matters, and exercises judgment for need of additional information.
Collaborate with teams to support improvement projects related to handling litigation matters.
Supervisory ResponsibilityThe nature of this position may involve providing direction to outside consultants and outside counsel on certain projects. This position may also assign projects to other paralegals.
Education/ExperienceA college degree is required plus five years of progressively responsible paralegal or related experience in a corporate Legal department; law firm environment or related field. A paralegal certification from an accredited paralegal program is required.
Strong preference for previous experience with Exterro, Office 365 Security and Compliance Center, and Legal Tracker. Must have exceptional ability to communicate effectively orally and in writing. Must be able to prepare accurate and complete work products; organize and prioritize workload and meet multiple coinciding deadlines; and establish and maintain effective working relations with others.
