This job announcement will be used to fill two vacancies. These positions are located at Central Office in St. Paul and may offer a hybrid schedule or in-office work. Incumbents will be required to make a telework arrangement with their supervisor and are expected to work in the office as determined by policy and discussion with supervisory leadership.
These positions ensure legal and policy compliance with the department’s obligation to provide timely and effective responses to both internal and external complaints of workplace discrimination, reprisal, and discriminatory harassment. Responsibilities include conducting complex investigations, handling overlapping issues (e.g., FMLA, workers’ compensation, contractual bargaining rights, and undue hardships), and writing and reviewing workforce policies. They will ensure adherence to current case law, regulatory guidance, and statutory requirements under state and federal laws including Title VII, the Equal Pay Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Minnesota Human Rights Act, and related statutes and policies.
The incumbents will serve as MnDOT’s primary contacts for discrimination-related matters and will confer regularly with the Minnesota Attorney General’s Office and Minnesota Management and Budget regarding internally and externally filed complaints and lawsuits. They will provide legal counsel to managers and Human Resources and manage key aspects of the statewide internal complaint process, including recommending informal resolution methods, determining investigative strategies, hiring contractors for expert discrimination investigations, drafting comprehensive investigative reports, and making findings and recommendations for follow-up.
Minimum QualificationsThree years of advanced professional experience applying state and federal non-discrimination law demonstrating the following:
- Performing complex legal and case analysis.
- Conducting all aspects of complaint investigations, including drafting investigative reports and findings, and providing follow-up guidance to management.
- Responding to discrimination complaints.
Note:
A Juris Doctor degree from an American Bar Association-accredited law school substitutes for one year of advanced professional experience.
