This position is located at Central Office in St. Paul and may have the flexibility to work a hybrid schedule, or work in the office. The incumbent will be required to make a telework arrangement with their supervisor. The incumbent will be expected to work in the office as determined by policy and discussion with their supervisor.
The Discrimination Law Supervisor will lead a team responsible for conducting nondiscrimination and harassment investigations, provide guidance, and perform final reviews of investigation reports and reasonable accommodation determinations to ensure MnDOT meets its obligations under applicable employment discrimination laws.
Key responsibilities include:
- Coordinate responses to discrimination charges filed with the Equal Employment Opportunity Commission (EEOC) and the Minnesota Department of Human Rights.
- Provide legal analysis of discrimination, harassment, and accommodation claims.
- Prepare MnDOT’s official position statements, clearly articulating all relevant legal and substantive defenses.
- Consult with and guide supervisors, managers, and HR professionals on issues related to employee discrimination, disability, protected classes, leave management and accommodation processes.
- Respond to subpoenas and formal information requests in compliance with applicable laws.
- Advise supervisors and managers on employment discrimination policies, state personnel laws, policies, and rules, and the Minnesota Government Data Practices Act to support informed decision-making and compliance.
- The Minnesota Department of Transportation does not sponsor applicants for work visas or Optional Practical Training Extensions for STEM Students. Individuals must be legally authorized to work in the US at the start of employment.
- Three (3) years of experience supervising professionals who conduct workplace investigations, represent employers in EEOC/Human Rights complaints by preparing position statements, or respond to complex ADA accommodation requests, including making undue hardship determinations.
- Four (4) years of advanced professional experience conducting workplace investigations or representing employers in EEOC/Human Rights complaints by preparing position statements and formal responses.
NOTE:
A JD degree from an American Bar Association accredited law school substitutes for one year of advanced professional experience.

- Legal drafting skills sufficient to communicate clear and concise findings in plain language to governing bodies, managers, supervisors, and staff.
- Legal analysis skills sufficient to comprehend case law, statutes, and regulations and to apply findings to specific facts and circumstances.
- Client counseling skills sufficient to provide complex information in a useful manner.
