ResponsibilitiesThe incumbent will conduct inspections on behalf of the federal Food and Drug Administration (FDA) to enforce compliance with federally mandated tobacco laws and regulations. The incumbent will also gather on-site data used for research and enforcement by the FDA Center for Tobacco Products and will conduct inspections on behalf of the Substance Abuse and Mental Health Services Administration (SAMHSA) to determine the state’s official tobacco retailer violation rate.
The duties include:
- Conduct tobacco compliance check inspections, including undercover buys to determine retailer compliance with age and photo identification requirements and other federal regulations under the Tobacco Control Act (2009).
- Advertising and labeling inspections to ensure retailers comply with the Tobacco Control Act provisions related to protecting youth from tobacco products.
Additional responsibilities include:
- Conduct inspections throughout the southwest region of Minnesota (approximately 90% travel) within 22 counties.
- Operate as a remote worker with home or alternate location as principal work location; vehicle provided for official business.
- Work in compliance tobacco checks and investigations as required by FDA and SAMHSA.
- Two (2) years of professional experience in one of the following: compliance checks, investigations, evidence collection or law enforcement.
- Plan, organize, and conduct inspections.
- Experience with technology such as iPhone, iPad, GPS, laptop, printer/scanner.
- Ability to create narrative reports with language sufficient to be upheld in a court of law.
- Maintain a valid driver’s license.
- Bachelor’s degree or higher in Law Enforcement/Criminology, Sociology, Psychology or related field may be substituted for one year of professional experience.
- Bachelor’s degree or higher in Law Enforcement, Criminology, Sociology, Psychology or related field.
- Experience conducting tobacco or alcohol compliance checks as an inspector or underage purchaser.
- Strong written and oral communication skills; ability to de-escalate hostile situations; ability to work independently and make critical decisions in the field.
- Working knowledge of state and federal statutes.
- Experience using technology (iPhone, iPad, GPS, laptop, printer/scanner).
- Incumbent must possess and maintain a valid driver’s license.
- Incumbent must be able to access their region within the first 30 minutes of the workday.
- Eligible to become a commissioned officer of the United States Department of Health and Human Services.
- Background checks are required:
Federal background check, Criminal background check, Reference check, Fingerprinting check (MNJIS/CJIS). - Complete CJIS Security Awareness training within 3 business days from start and maintain CJIS certification annually.
