ResponsibilitiesChief Objective: This attorney serves as Section Chief of the Health Services Section. Along with the Section’s attorneys, this attorney serves as counsel to the Department of Behavioral Health and Developmental Services and its hospitals, training center, and sexually violent predator facility (the Virginia Center for Behavioral Rehabilitation); the Department of Health; the Department of Health Professions and its regulatory boards;
the Department for the Blind and Vision Impaired; the Virginia Board for People with Disabilities; the Department for the Deaf and Hard of Hearing; and the Department for Aging and Rehabilitative Services and its Wilson Workforce and Rehabilitation Center. This attorney manages the nine attorneys in the Health Services Section to ensure that legal assistance to the Section’s client agencies is of high-quality and provided in a timely manner.
In addition, this attorney manages her own caseload as necessary.
Work Tasks and Duties:
- Manage and supervise section attorneys and staff
- Review legal advice provided by section attorneys
- Review pleadings and briefs of section attorneys prior to filing
- Assist section attorneys in providing legal advice as necessary
- Draft pleadings and appear in state and federal court on behalf of clients
- Represent client agencies at administrative hearings and meetings
- Respond to requests for legal advice and counsel from client agencies, either orally or in writing
- Attend meetings to support client agencies
- Provide legal advice and guidance during meetings for client agencies as requested
- Review regulations in accordance with the Administrative Process Act and applicable law
- Provide training to client agency staff regarding the administrative process, FOIA compliance, conflicts of interest, and confidentiality
- Provide training to stakeholders on civil commitment, confidentiality, consent to treatment, and human rights
- Review proposed legislation as assigned
- Review contracts and memoranda of agreement
- Review policies and procedures developed by client agencies
- Knowledge of the laws related to client agencies
- Knowledge of Virginia administrative law
- Knowledge of fundamental subjects in law
- Knowledge of legal research procedures and ability to perform thorough legal research
- Knowledge of the preparation of briefs and presentation of arguments for cases before state and federal courts
- Knowledge of applicable court rules, rules of evidence, administrative rules and procedures
- Knowledge of the practices and procedures of the Office of the Attorney General
- Ability to manage attorneys and administrative staff
- Ability to communicate effectively, both verbally and in writing
- Ability to use judgment, tact and discretion
- Ability to quickly assimilate oral and written data, to analyze facts, and draw logical conclusions
- Ability to express legal interpretations or conclusions of law clearly and logically in oral and written form
- Ability to provide direction to other attorneys and administrative staff
- Ability to maintain records, and prepare reports and correspondence related to the work
- Ability to coordinate and function as a lead attorney or counsel in litigation filed against agency clients
- Ability to identify and analyze issues and problems in management and human relations and to recommend and implement solutions
- Ability to maintain favorable public relations
- Supervisory and leadership skills
- Skills of persuasion and consensus building
- Computer literacy to include proficiency with Microsoft Office Suite
