Overview
TITLE: Assistant Prosecuting Attorney - Appellate Division II
OBJECTIVE: Incumbent is responsible for initiating and responding to all appeals from Criminal and Civil Division cases to the 11th District Court of Appeals, The Ohio Supreme Court and all Federal Courts.
Responsibilities- Filing Appeals from adverse rulings in cases in the Criminal and Civil Division of the Prosecutor’s Office when so directed by the Chief Assistant Prosecutors of the Division or the Prosecuting Attorney;
- Filing responses to Appeals and post-conviction proceedings taken by defendants in criminal cases or any party in civil cases;
- Preparing all requisite notices, motions, and briefs in said appeals in a timely manner;
- Conducting oral arguments in all appeals before State and Federal Appellate Courts;
- Prepare and present seminars for Assistant Prosecutors and local law enforcement personnel;
- Conduct research and writing memoranda on specific legal issues arising in the course of prosecution or litigation upon request of the Chief Assistant Prosecutors or the Prosecuting Attorney.
Juris Doctor Degree is required. Incumbent must pass the bar exam and be licensed to practice law in the State of Ohio and in good standing with the Supreme Court of Ohio.
EquipmentIncumbent operates the following equipment: computer scanner, smart phone, computerized docketing system, fax machine, and copier.
Critical Skills/Expertise- Comprehensive knowledge of the legal system;
- Ability to prepare and present seminars for law enforcement personnel;
- Ability to communicate effectively, both orally and in writing
- Knowledge of researching skills;
- Highly skilled in computer legal research;
- Knowledge of the Rules of the Court, the Ohio Revised Code, Administrative Code, Criminal Rules, etc.
Juris Doctor Degree is required. Incumbent must pass the bar exam and be licensed to practice law in the State of Ohio and in good standing with the Supreme Court of Ohio.
Difficulties of WorkWork consists of complex, varied, non-standardized tasks requiring the application of numerous laws, rules, regulations, and procedures.
ResponsibilitiesIncumbent directs the work activities of investigators, legal assistants, paralegals, interns and clerks. Supervisor provides detailed and technical instructions regarding procedural issues, and reviews work of incumbent. Incumbent makes most decisions regarding work independently.
Personal Work RelationshipsIncumbent has contact with law enforcement officers, co-workers, employees in the department, public and private sector employees, court personnel, institutional residents, and the general public. The purpose of these contacts is to provide legal advice for County and Township and city law enforcement officers.
Physical RequirementsIncumbent performs sedentary work which may require lifting up to fifteen (15) pounds occasionally.
