position summary

a senior attorney employed by the office of statewide prosecution serves as an assistant statewide prosecutor and assistant statewide grand jury legal adviser, under the direction and supervision of a bureau chief assistant statewide prosecutor.

qualifications
  • membership in the florida bar and five (5) years of criminal trial experience.
  • preference may be given to applicants with criminal prosecution experience.
the work you will do
  • reviewing and evaluating evidence for prosecution of criminal cases.
  • submitting all necessary data and recommendations to the chief assistant for intake decisions to accept or reject cases for prosecution.
  • advising and assisting the investigating agency in investigation completion and preparation of cases for prosecution, including review of search warrants, electronic surveillance applications and orders, arrest affidavits and warrants; taking voluntary statements; consulting with experts on technical evidence; researching applicable laws and applying them to the facts.
  • making charging decisions based on relevant factors in consultation with the bureau chief assistant.
  • establishing contact and coordination with other divisions within the department of legal affairs, or other law enforcement or regulatory agencies, for pursuing civil or administrative remedies when appropriate.
  • preparing and filing charging instruments.
  • coordinating surrender or arrest of criminal defendants on filed charges when possible.
  • representing the state at bond hearings.
  • determining the scope of discoverable materials and ensuring compliance with discovery requirements; attending depositions of all witnesses.
  • representing the state in pre-trial motion practice and at all calendar calls of the court.
  • representing the state at trial on the charges and at post-trial hearings and sentencing proceedings.
  • maintaining contact with the assistant attorney general handling appellate matters and assisting with record preparation and appellate issue analysis as needed.
  • requesting recovery of costs associated with prosecution and investigation.
  • conducting and memorializing post-case review sessions with investigating agencies and supervisors to evaluate effectiveness of prosecution strategies.
  • participating in the statewide grand jury process under the supervision of the statewide prosecutor, when appropriate.
  • following policies regarding the operation of the statewide grand jury, including subpoenas, travel and expense rules, and scheduling.
  • attending investigative intelligence meetings and task forces to support an integrated approach to organized crime, as directed.
  • maintaining documentation of work performed and data entry in the case tracking system.
  • assisting in the formulation of legislative priorities for criminal justice reform and drafting related proposals or analyses.
  • representing the office with professional and ethical conduct.
  • maintaining ongoing professional development and knowledge of office policies and procedures.
  • traveling as required to perform investigative, litigation, and training functions of the office.
