Overview

OUR BOUTIQUE COMMERCIAL LAW FIRM HAS A PROGRAM TO TRAIN ITS ASSOCIATE ATTORNEYS.

At the Nissenbaum Law Group, LLC entering associates will typically be provided with a 2-4 week intensive training program overseen by our managing attorney. The purpose is to steep our new attorneys in a wide latitude of topics so they will be ready to take on complex commercial litigation and attorney ethics defense matters that will be challenging for them.

The topics vary based upon the associate’s background and the availability of our staff and attorneys to teach them. But, generally speaking, they consist of the following sixteen (16) modules:

  • Our Law Firm’s Internal Administration and Procedures
  • Our Law Firm’s Pro Bono/Low Bono Legal Practice
  • An Overview of the Civil Litigation System
  • 75 Court Rules Every Litigator Should Know
  • Advanced Brief Writing
  • Drafting Techniques for Pleadings, Discovery, and Motions
  • Mock Trial Presentation Utilizing Files of an Actual Trial Our Firm Handled
  • Commercial Bankruptcy with an Emphasis on Chapter 11 Business Filings
  • Corporations, Partnerships, and Limited Liability Companies
  • Intellectual Property (Copyright, Trademark, and Trade Secret Law)
  • Contract Drafting and Commercial Closings
  • Attorney Ethics: the New Jersey, New York, and Pennsylvania Rules of Professional Conduct and Corresponding Procedures for (a) Ethics Investigations and Hearings and (b) Attorney Trust Account Audits
  • Emotional Intelligence (Reading Group Discussion and PowerPoint Presentation Concerning the Book Primal Leadership: Unleashing the Power of Emotional Intelligence)
  • Mitigating Risk in the Practice of Law (Reading Group Discussion and PowerPoint Presentation Concerning the Book The Black Swan (Second Edition): The Impact of the Highly Improbable)

In short, this is a job for people who want to accelerate their development as attorneys.

We are committed to:

(A) Training our attorneys in the legal complexities of commercial litigation and attorney ethics defense and

(B) Fostering an emotionally intelligent work environment in which our attorneys can have a role in determining whether or not they work from home or the office.

  • First, the quality of the legal work and the sophistication of our anchor clients are equivalent in all respects to those you would find in Big Law (at least in our biased opinion). Yes, we have a smaller census of attorneys and staff than those firms, but the legal practice has the same feel; that will be obvious the first week you are here.
  • Second, the hours are not insane. Of course, this is still more than a 9:00am to 5:00pm job, but you are also generally able to have weekends and vacations to yourself. You know why we put the word “generally” in there, but the point is that we are not striving to find out how long you can put your head underwater without drowning in work.

    We respect your need to have a life.
  • Third, the foundation of our firm is that we strive to practice law with emotional intelligence (EQ). That applies to how we interact with our clients, adversaries, vendors and more to the point, one another. We eschew anger and aggressiveness; we do not find the suffering or failures of others humorous; and we approach our role as attorneys with kindness, compassion and empathy.

  • Fourth, we leaven all that with a relentless pursuit of excellence in our work product and the goal of achieving the right result for our clients. As lawyers, we have to hammer away at what we want, why we should get it, and why what our adversaries want is completely and totally undeserving of consideration. The approach has to be unrelenting.

    We are in litigation to do battle against the adversary’s arguments (though of course not the adversary themselves). If we are winning, we keep going. If we are losing, we keep going. We simply don’t stop. (Admittedly, we are a bit more accommodating in our transactional negotiations, should the situation warrant it.)
