Overview
Position Overview The Litigation Manager supports and manages the organization’s litigation and pre-litigation matters, with strong emphasis on employment-related disputes including wage and hour claims, discrimination allegations, and regulatory complaints. Occasionally, claims may be related to workers’ compensation or safety issues. This role blends litigation coordination, early case resolution, and communication with outside counsel and internal teams. The Litigation Manager plays a key role in evaluating, negotiating, and resolving threatened litigation before it escalates.
This role is 100% remote anywhere in the US.
- Pre-Litigation & Settlement Negotiation
- Handle pre-litigation claims and threatened litigation, including demand letters, attorney inquiries, and early dispute escalation.
- Conduct early case assessments to evaluate exposure, documentation strength, and likelihood of settlement.
- Coordinate and participate in settlement negotiations, mediations, and informal resolution discussions.
- Work with HR, Operations, in-house and outside counsel to develop strategies to resolve disputes efficiently and minimize litigation risk.
- Prepare settlement summaries, negotiation notes, and release documents as needed.
- Litigation Support & Case Management
- Manage all employment-related litigation, including FLSA wage/hour claims, discrimination, harassment, retaliation, and wrongful termination cases.
- Draft, review, and organize pleadings, discovery responses, subpoenas, and deposition materials.
- Maintain litigation calendars, track deadlines, and monitor case milestones.
- Coordinate litigation holds and ensure preservation of documents across departments.
- Employment Law & Agency Support
- Prepare documentation and draft responses for EEOC, DOL, OSHA, and state labor board matters.
- Conduct fact gathering and intake interviews for employee complaints, audits, and investigations.
- Coordinate with HR to collect personnel files, timecards, training documentation and witness statements.
- Conduct internal investigations related to discrimination, harassment, wage/hour issues, and workplace safety.
- Operational & Field Coordination
- Work directly with site supervisors and regional managers to gather evidence such as timekeeping logs, job site documentation, incident reports, shift schedules, and client communications.
- Oversee claim with carrier’s claim handlers and defense counsel, involving slip-and-fall incidents and equipment-related injuries, including self-performed and vendor managed locations.
- Identify documentation or compliance gaps that increase risk and recommend corrective actions.
- E-Discovery, Document Management, Outside Counsel
- Oversee collection, organization, and production of documents for subpoenas and discovery requests.
- Coordinate with IT to support data preservation and retrieval.
- Serve as the primary contact for outside counsel, ensuring timely communication and organized case support.
- Schedule strategy calls, case assessments, and review of work product.
- Review legal invoices and ensure they adhere to budget guidelines.
- Reporting, Internal Communication and Compliance
- Prepare case status reports, risk assessments, and settlement summaries for senior management.
- Oversee dashboards tracking claims, settlements, costs, and litigation outcomes in Salesforce.
- Track legal trends across job sites and identify patterns requiring leadership action.
- Ensure compliance with labor laws and company policies.
- Provide training to supervisors and field managers on incident reporting, documentation standards, and litigation risks.
- Paralegal Certificate with 3 years of litigation support experience, or bachelor’s degree in related field. J.D. preferred.
- 3-5 years of employment law exposure.
- Experience with pre-litigation employment law claims handling and settlement negotiations.
- Experience with wage/hour audits, collective/class action support, and mediation coordination.
- Experience handling high-volume claims involving hourly work forces in janitorial, hospitality, or staffing industry.
- Strong judgment and ability to evaluate settlement value and risk.
- Strong understanding of labor and employment processes including EEOC, wage/hour, and agency matters.
- Excellent writing, research, organization, and communication skills.
- Proficiency with e-discovery tools and case management systems.
- Ability to communicate effectively with field supervisors and non-legal personnel.
- Highly organized with strong attention to detail and deadline management.
- Fast-paced, multi-site environment requiring collaboration with Human Resources, Payroll, Operations, Safety, in-house and outside counsel.
