Workplace Legal has an immediate opening for an experienced employment litigator.
In this position, your clients will be large corporations, small businesses, startups, and high-level executives and professionals. Your responsibilities will include interviewing and meeting with clients, developing litigation strategy, performing legal research, drafting pleadings, managing discovery, and drafting and responding to dispositive motions. You will get to take and defend depositions, argue motions, prepare witnesses and experts, and serve as first- or second-chair 'll also attend Labor Commissioner hearings, LWDA "cure conferences", arbitrations, and mediations.
Although the majority of your work will be litigation-focused, you will also get to work on the firm's advice-and-counsel matters. You will be advising employers on high-stakes employee issues, drafting incentive compensation and other employment agreements, working with startups and small businesses on HR infrastructure buildouts, and advising C-Suite executives on offer packages, departure strategies, and severance negotiations.

Founded in 2018, Workplace Legal is an AV-rated law firm of “Super Lawyers” that represents corporate and individual clients in California and New York in complex labor, employment, and HR matters. We work on interesting employment law cases and interact with smart, demanding clients, both as plaintiffs and defendants. We do “big law” quality work at Workplace Legal because our lawyers come from prestigious big law firms.
But we left big law because we grew weary of the billable hour rat race, the required face time, and the office politics. We wanted a different way to practice law.
The result was Workplace Legal.
Founded on January 1, 2018, Workplace Legal exists to give smart, ambitious, and business-minded employment lawyers an alternative to the big law rat race. We pay well, we offer full benefits, we have a comparatively low billable hour requirement, and we offer a path to Shareholder status. We also are a fully remote firm, which we’ve been since our founding – long before other law firms started pretending to allow remote work.
And we invest heavily in AI and other technology to make our lawyers more efficient and productive.
This firm has set an ambitious growth plan for . Our goal is to add 2-3 new attorneys in California, and 1-2 new attorneys in New York, within the next 18 months. Our business is booming. Now, we just need to find the right people -- smart, friendly, and ambitious people who like each other, have a sense of humor bigger than their ego, and who want to build and grow a firm that practices both plaintiff-side and employer-side employment law at the highest levels.
Compensation and Benefits
In accordance with California’s pay transparency law, the expected salary range for this position is between $150,000/year - $200,000+/year for a 1,200 billable hour commitment. Your actual salary will depend on your experience and other job-related factors as permitted by law.
In addition you to your salary, you will be eligible for quarterly bonuses based on revenue collected from your billed hours as well as on any cases you originate. We estimate that these bonuses could bring your total annual compensation to $175,000/year to $225,000/year (or more).

Requirements
To be considered for this position, you must:
- Be licensed to practice law in California
- Have 2+ years California employment litigation experience
- Live in the San Francisco Bay Area (or be willing to travel here as necessary)
- Be analytical, smart, ambitious, and focused on delivering high quality legal work
- Be creative, flexible, and able to work independently and collaboratively
