About

the role

Core responsibilities:

  • Handle case management from file inception to matter close, efficiently and professionally;
  • Draft estate planning documents including revocable and irrevocable trusts and conducting client meetings (design, review and signing);
  • Manage probate and trust administration projects (settling probate estates and trust administrations), including gathering information from the client and preparing and filing probate forms and notices, trust and probate accountings, closing estates with the probate court, preparing trustee acceptance and appointment documents, preparing letters of instruction to retitle estate assets, draft deeds, trustee certificates and declarations of homestead;
  • Manage Mass Health files, either preplanning matters analyzing assets and spend down strategies for eligibility, or preparing applications and supporting documentation, including the review of bank and other financial statements and formatting of such information for caseworker review.
  • Complete initial trust funding services that will involve a review of client assets and legal ownership to recommend changes in death beneficiaries, owners, and lifetime transfers.

Other responsibilities may include:

  • Advising clients on wealth transfer strategies, that may include advanced estate tax planning, business succession planning, special needs planning, and retirement and income tax planning, and long-term care planning;
  • Preparing estate tax returns; and
  • Guardian ships and conservatorships (including attending court hearings).
Qualifications
  • 2+ years’ experience in estate planning, estate and trust administration, or elder law;
  • Admitted to practice law in The Commonwealth of Massachusetts;
  • You have experience in drafting estate planning documents, including trusts and have an understanding of the tax issues relating to income, capital gains, and estate taxes and an understanding of the Secure Act as it relates to estate planning;
  • You have experience in probate matters from the initial filings, any motions, and closing of the matter;
  • You produce trust/fiduciary accounting for trust administration and probate/estate administration purposes;
  • You have knowledge of the MUPC, and MUTC, as well as Mass Health regulations;
  • Preferably, you have experience preparing and filing Massachusetts estate tax returns on M-706, coordinating with clients and service providers (CPAs, Financial Advisors, and Insurance Providers) to receive supporting documentation, and preparing and filing extensions where necessary.
What we offer

35 hour work week, 9 a.m. to 5 p.m.

PTO with an extra week off the Week of 4 th of July
