Duties

The Administrative Law Judge, under the title of Motor Vehicle Referee, will be engaged in professional legal work conducting administrative hearings and rendering decisions for the adjudication of moving traffic violations, including those involving fatal accidents, persistent violators, false statements on motor vehicle documents, or driving without insurance. They will also conduct hearings involving violations of the Vehicle and Traffic Law and the Commissioner’s Rules and Regulations by commercial establishments such as repair shops, dealers, inspection stations, driving schools, commercial bus drivers, and school bus operators.

In some cases, the incumbent will prepare cases for review by the Motor Vehicle’s Appeals Board. In addition, the judge will render decisions for violations of the Navigation Law by boaters, and for the Parks, Recreation, and Historic Preservation Laws by operators of snowmobiles. Decisions are also influenced by the Zero Tolerance Program and new regulations concerning emission inspections.

Minimum Qualifications
  • Admission to the NYS bar and at least two years of post‑licensure professional legal experience (Administrative Law Judge – SG‑25).
  • 12 months as an Assistant Attorney‑2 or admission to the NYS bar plus 12 months of satisfactory legal experience in trial of issues in courts of record or quasi‑judicial adversary proceedings (Assistant Administrative Law Judge – SG‑22).
  • One year of permanent, contingent‑permanent, or 55 B/C service at Grade 21 or higher that is deemed administrative under Section 52.6 of the Civil Service Law; or service in a title approved for transfer under Section 70.1 of Civil Service Law.
  • Reinstatement eligibility for former service in this title within one year of departure, or otherwise approved by the Civil Service Commission for service beyond one year.
  • 55 B/C designation eligibility, with a current 55 B/C eligibility letter. Candidates must meet at least one of the open‑competitive qualifications listed.
  • Eligibility for the NY HELPS Program for short‑term placement.
Preferred Qualifications
  • High motivation to work in public service as part of an active legal team.
  • At least three years’ experience as a New York State Attorney.
  • Strong research and writing skills, eager to learn new subject areas.
  • Demonstrated sound judgment and excellent oral communication skills.
