Marketing Counsel
Our client is hiring a Marketing Counsel to serve as a trusted legal partner for Marketing and Brand initiatives. This role focuses on advertising compliance, promotional reviews, and intellectual property guidance within a fast-paced, highly regulated industry.
ResponsibilitiesMarketing & Advertising Compliance
- Review and approve promotional campaigns and terms including acquisition offers, loyalty programs, odds boosts, and product-related promotions.
- Ensure all marketing efforts comply with federal and state laws, advertising standards, and gaming regulations.
- Partner with creative and compliance teams to ensure promotional messaging is fair, accurate, and transparent.
Marketing Asset Review
- Provide legal review of marketing assets including digital ads, email campaigns, social media, affiliate content, influencer marketing, and media buys.
- Draft and refine disclaimers and disclosures to meet regulatory standards while maintaining brand alignment.
- Advise on trademark use, brand protection, and licensing matters across digital and traditional platforms.
- Assess third-party trademarks and NIL usage to mitigate risks.
- Support agreements involving sponsor ships, partnerships, and collaborations to safeguard IP rights.
Strategic Legal Support
- Educate internal teams on best practices, legal risks, and compliance requirements.
- Monitor advertising law, gaming regulations, and IP developments to identify business impacts.
- Streamline internal legal review processes to support timely execution.
- Juris Doctor (JD) from an accredited law school; licensed in New York or eligible for in-house counsel registration.
- 3 - 8+ years of legal experience in a law firm or corporate legal department, preferably in gaming, technology, media, or entertainment.
- Strong understanding of U.S. advertising laws (FTC Act, CAN-SPAM, TCPA, NAD decisions) and gaming regulations.
- Experience with promotional terms, sweepstakes/contest rules, and digital marketing campaigns.
- Knowledge of intellectual property law including trademark clearance, registration, enforcement, content licensing, and NIL.
- Excellent communication skills with the ability to deliver practical, business-focused legal advice.
- High attention to detail, sound judgment, and strong business acumen.
- Prior background working in a regulated industry
- Knowledge of state-specific marketing and gaming compliance requirements.
- Familiarity with digital marketing tools, influencer compliance, and affiliate networks.
$168 - 210k estimated base salary + competitive bonus, equity package, in addition to very strong benefits
