Position Objective

The Deputy General Counsel e-Discovery and FOIL is an experienced attorney who will lead the MTA’s e-Discovery and FOIL Unit, providing legal and technical e-discovery support to the legal departments of all MTA agencies. The unit will handle FOIL requests, subpoenas, e-discovery searches, and guidance on collection and preservation of documents in litigation. The Deputy will stay current on best practices, supervise legal and technical staff, provide subject‑matter expertise to agency attorneys, and assist with procurement of technical resources.

Responsibilities
  • Supervise, manage, train, and develop staff in the e-Discovery and FOIL Unit, providing coaching, performance reviews, and discipline when necessary.
  • Stay current on e-Discovery and FOIL best practices, legal requirements, and emerging technology.
  • Oversee e-Discovery matters, coordinating with agency legal staff and IT for searches in lawsuits and information requests, including FOIL requests and subpoenas.
  • Advise legal staff on electronic searches, evaluate overbroad or burdensome requests, and recommend responses.
  • Assist in setting up document reviews, advising on search terms, protocols, and production logistics.
  • Provide guidance on collection, preservation, and litigation hold processes for electronic documents.
  • Review FOIL requests to headquarters and agencies, providing guidance to paralegals and ensuring correct responses.
  • Help evaluate and procure technical resources for the e-Discovery and FOIL Unit.
  • Perform other duties as assigned.
Required Knowledge, Skills, and Abilities
  • Extensive experience with all aspects of e-discovery and FOIL support, including document production and privilege review.
  • Technical proficiency with Microsoft Office applications.
  • Ability to use established discovery platforms and knowledge of evolving e-discovery technologies.
  • Substantial knowledge of policies, regulations, court rules, and case law regarding e-discovery and FOIL.
  • Proven ability to manage and train staff.
  • Strong oral, written, and analytical skills.
  • Exercise of independent judgment and discretion.
  • Excellent communication skills.
  • Proficiency in Microsoft Office Suite or comparable applications.
Required

Education and Experience
  • Law Degree from an accredited law school and admission to the New York State Bar.
  • Minimum of ten (10) years of significant e-discovery and FOIL management experience at a law firm, governmental agency, or corporation.
  • Prior supervisory experience over a professional legal staff.
Preferred Qualifications
  • Budget responsibility in prior experience.
  • Familiarity with the MTA’s policies and procedures.
  • Familiarity with the MTA’s collective bargaining procedures.
Other Information
  • May need to work outside normal hours (evenings and weekends).
  • Travel may be required to other MTA locations or external sites.
  • All employees holding a policy making position must file an Annual Statement of Financial Disclosure with the NYS Commission on Ethics and Lobbying in Government.
