The Assistant Litigation Counsel
The Assistant Litigation Counsel is responsible for assisting the Associate Litigation Counsel in managing the legal affairs of West Virginia United Health System, Inc. and related entities. The position reports to the Associate Litigation Counsel and AVP/Senior Litigation Counsel.
Minimum Qualifications- Juris Doctorate or equivalent degree.
- West Virginia Bar membership or eligibility to obtain WV bar membership within 90 days of employment.
- Three (3) years prior experience in litigation.
- Experience in medical malpractice and general liability matters.
- Provides day-to-day legal representation to WVUHS and its related entities in medical malpractice and general liability matters, administrative hearings, and other litigation-related matters.
- Performs tasks in medical malpractice and general liability claims and cases and other litigation-related matters.
- Conducts employee and witness interviews in preparation for defense of claims and cases.
- Performs legal research and prepares legal memoranda addressing legal issues presented in matters involving WVUHS and its related entities.
- Prepares case summaries, pleadings, motions, discovery requests and responses, and other case-related materials.
- Participates in planning and executing discovery plans, alternative dispute resolution, hearings, and trial strategies for claims and cases.
- Interviews and prepares witnesses for case development, discovery, depositions, administrative hearings, and/or trial testimony.
- Appears as counsel on behalf of WVUHS and its related entities and employees at discovery depositions, administrative hearings, mediations, hearings, and trials, either independently or with Associate Litigation Counsel, AVP/Sr. Litigation Counsel and/or outside counsel.
- Provides assistance to Associate Litigation Counsel and AVP/Senior Litigation Counsel in dealing with legal issues, including conducting legal research, fact-gathering, and other investigatory activities.
- Assists with policy review and development, employee education.
- Assists outside counsel retained by AVP/Sr. Litigation Counsel or General Counsel/Chief Legal Officer with case-related tasks and serves as a liaison between outside counsel and WVUHS and its related entities and employees.
- Works collaboratively with nurse paralegals and litigation paralegals on legal matters on behalf of WVUHS and its related entities.
- Other duties as assigned by General Counsel/Chief Legal Officer, Associate Litigation Counsel or AVP/Senior Litigation Counsel.
- Demonstrates regard for the dignity and safety of all patients, family members, visitors, and hospital personnel as defined in the philosophy of the organization.
- Displays courteous and professional attitude and represents WVUHS in a positive manner 100% of the time.
- Maintains proper attendance and punctuality to ensure the department operates efficiently and cost-effectively.
- Provides adequate notice to supervisory personnel prior to absence or tardiness in accordance with departmental policy.
- Participates in planning and implementing change and maintaining and improving productivity through attendance and participation in staff meetings, task forces, standing committees, special projects and discussions with supervisors.
- Ability to concentrate and sit at a desk for long periods of time.
- Ability to work in a fast-paced environment including live hearings.
- Visual requirements:
Near Vision, Depth Perception, Extensive Exposure to Video Displays. - Ability to hear normal conversation and telephone communications.
- Occasional lifting, carrying, pushing and/or pulling up to 25 lbs.
