The Virginia Alcoholic Beverage Control Authority (Virginia ABC) is currently seeking applicants for a part time Administrative Law Judge 2 to conduct informal conferences and formal administrative hearings in compliance with the Virginia Administrative Process Act, the Code of Virginia and ABC Board regulations and policy. This position supports the Authority’s mission to regulate ABC licensees and customers; impose sanctions as appropriate;

rule on continuance requests; and mediate contested matters as assigned.

Hourly Rate

  • $54.66- $71.06/hr depending on experience and qualifications

This is a wage position with no benefits, not to exceed 1500 hours per year.

Schedule Requirements:

  • Work hours will vary from week-to-week

Areas of Responsibility

  • Conduct informal conferences and formal administrative hearings in compliance with the Virginia Administrative Process Act, the Code of Virginia and ABC Board regulations and policy
  • Responsible for deciding procedural, factual and legal issues involved in the hearing and appeals process.
  • Evaluating and ruling on evidentiary and pre-trial matters including requests for continuances.
  • Interpreting and applying applicable law, regulations and policy.
  • Advising and assisting staff and interested parties in conducting hearings and appeals business.
  • Determining appropriate sanctions consistent with applicable law, regulations and policy; issuing timely logical and understandable decisions and rulings.
  • Ensuring timely, efficient and effective conduct of hearings and appeals under established policy and standards.

Minimum Qualifications

  • Must be an attorney and member in good standing with the Virginia State Bar.
  • Minimum of five (5) years experience as a practicing attorney.
  • Extensive knowledge of the administrative or judicial hearing processes and drafting of judicial decisions in either Virginia or federal courts.
  • Knowledge of the Virginia Administrative Process Act and ABC laws and regulations.
  • Knowledge of regulatory and hearings processes and practices, due process requirements and the U.S. and Virginia judicial systems.
  • Extensive communications skills including effective reading, writing and speaking.
  • Advanced skills in the use of Microsoft Windows, Word and Excel.
  • This position requires travel within the Commonwealth of Virginia to attend hearings.

It is possible for this position to be held remotely outside of the Central Virginia area. However, the role will still require travel within the Commonwealth of Virginia to attend hearings. Mileage for travel shall be reimbursed in accordance with Virginia ABC policy.

Virginia ABC employees are covered under the Commonwealth’s benefits package and VRS. However, Authority employees are exempt from the Virginia Personnel Act and the Virginia Public Procurement Act.
