Position Overview

The Associate Attorney will independently handle immigration matters involving both EOIR and USCIS proceedings
, under the supervision of the principal attorney. The associate is expected to analyze statutes and caselaw, develop legal strategy, draft filings, appear in immigration court as needed, and manage cases from intake through resolution.

The associate will also supervise support staff working on assigned cases, ensuring accuracy, efficiency, and strict compliance with deadlines.

This is not an entry-level or high-volume role
.

Primary Responsibilities

EOIR & Appellate Practice
  • Represent clients in removal proceedings before EOIR
  • Draft and litigate:
  • Motions to reopen and reconsider
  • Motions to terminate
  • Custody and bond-related filings
  • Prepare and file BIA appeals
  • Independently analyze immigration statutes, regulations, and precedent decisions
USCIS Representation
  • Handle complex USCIS matters, including:
  • Adjustment of status
  • Waivers and discretionary relief
  • U-Visa and T-Visa related filings
  • Legal advocacy submissions and responses
  • Review and oversee USCIS filings prepared by support staff
  • Develop case theory and legal arguments for discretionary applications
Legal Research & Writing
  • Conduct in-depth legal research on complex immigration issues
  • Draft high-quality motions, briefs, and memoranda
  • Prepare and review declarations and evidentiary submissions
  • Familiarity with criminal-immigration issues is a huge plus
Case Management & Supervision
  • Manage assigned cases from intake through resolution
  • Supervise paralegals and law clerks assigned to cases
  • Delegate tasks clearly and review work product for accuracy and completeness
  • Ensure strict compliance with court and agency deadlines
Client Communication
  • Communicate directly with clients regarding case strategy and status
  • Coordinate with administrative staff for scheduling and logistics
  • Maintain professional standards in all client interactions
Qualifications
  • 1–3 years of immigration law experience
    , including:
  • EOIR proceedings
  • USCIS applications and petitions
  • Active license to practice law in at least one U.S. jurisdiction
  • Demonstrated ability to analyze caselaw and develop legal strategy independently
  • Strong legal research and writing skills
  • Experience supervising or coordinating with support staff
  • Comfortable handling responsibility in a low-volume, high-stakes practice
  • Spanish fluency strongly preferred

Pay: $80,000.00 - $ per year
