The Homeowner Protection Unit (HPU) is the OAG’s dedicated team for safeguarding Hoosier homeowners and tenants from deceptive, unfair, and abusive practices connected to real estate transactions. HPU enforces consumer protection laws in matters involving mortgage lending and servicing, deed and title fraud, landlord–tenant disputes, rent‑to‑own and land contract disputes, homeowners’ association compliance, and other deceptive business practices tied to real estate transactions.

We are seeking a litigation‑focused attorney who is motivated by consumer protection issues and brings interest or knowledge in real estate matters. The successful candidate will lead and support complex civil enforcement actions that protect housing stability and property rights across Indiana. HPU values consumer‑centered advocacy, rigorous legal analysis, and collaborative problem‑solving.   • Litigate complex consumer protection cases in Indiana trial courts (and, where appropriate, federal court) arising from HPU’s statutory authority, including:
    • Landlord–tenant matters (habitability, illegal lease terms, improper billing/fees, manufactured housing issues).
    • Rent‑to‑own and land contract cases involving predatory or deceptive practices.
    • Mortgage and deed fraud, including seller impersonation and title/quitclaim deed schemes.
    • Homeowners’ association (HOA) disputes concerning HOA compliance with Ind. Code § 32‑25.5‑3.
    • Other deceptive business practices related to real estate transactions (e.g., unlicensed real estate brokering/wholesaling, foreclosure/mortgage rescue scams).
  • Own all phases of civil enforcement: drafting complaints, motions, briefs, discovery, depositions, hearings, and trials; seeking injunctive relief, restitution, civil penalties, costs, and other remedies under the Deceptive Consumer Sales Act, Home Loan Practices Act, Mortgage Rescue Protection Fraud Act, and other related statutes.
  • Develop case theories and manage investigations with HPU investigators and examiners; conduct witness interviews; review records (e.g., county recorder filings, loan servicing documents), and evaluate facts for legal violations.
  • Negotiate resolutions, including Assurances of Voluntary Compliance (AVCs), consent judgments, and settlements that deliver timely consumer relief and structural reforms.
  • Coordinate with partner agencies and stakeholders, including local health departments, IHCDA, IURC, law enforcement, and federal counterparts, to address housing‑related consumer harms.
  • Triage and prioritize intake to focus resources on high‑impact cases; ensure accurate, timely documentation of case activity in Advologix (Salesforce) consistent with office policies.
  • Maintain professional relationships with colleagues, opposing counsel, courts, community organizations, and the public; represent the State with integrity and civility.
  • Pursue continuous development through trainings, CLEs, and monitoring of relevant case law and statutes in consumer protection and real estate.
  • Admitted to the Indiana Bar.
  • Strong civil litigation skills, including legal research and writing, oral advocacy, and case management for complex matters.
  • Commitment to consumer protection with demonstrated interest or knowledge in real estate (landlord–tenant, mortgage/servicing, HOA, title/deed issues).
  • Ability to manage a substantial docket, collaborate across teams, and serve as a self‑starter in a fast‑paced environment.
  • Proficiency with legal technology and case‑management systems.

Title and classification will be determined based on relevant experience, subject‑matter expertise, and demonstrated skills in the areas above.
