The role incumbent will be responsible to handle non-litigation legal and regulatory matters of the organisation, with a solutions-oriented approach and excellent decision-making skills.
About the Role
The Area Manager-Legal will be responsible for managing various legal and regulatory aspects of the organization, ensuring compliance and providing legal advice on operational matters.
Responsibilities
Provide legal advice on operational and business matters, including documentation and regulatory compliance.
Draft, review, and vet agreements, contracts, MoUs, and other legal documents pertaining to retail transactions.
Ensure the accuracy and completeness of loan agreements, sanction letters, mortgages, and security creation documents.
Verify title deeds and legal ownership of collateral/security provided for loans.
Monitor and ensure compliance with banking and NBFC regulations, including RBI guidelines, SEBI norms, and other applicable laws.
Address legal queries related to lending, recovery, and other operations.
Handle pre-litigation matters such as customer disputes, notices, and mediation.
Resolve disputes with customers, vendors, and other third parties amicably or through arbitration.
Identify and mitigate legal risks in business operations, particularly related to loan disbursement and recovery.
Conduct periodic reviews of legal processes and suggest improvements.
Provide legal assistance in the recovery of overdue loans.
Draft and execute notices under SARFAESI Act or other applicable recovery frameworks (non-court procedures).
Liaise with government bodies, registrars, and regulators for various approvals and filings.
Maintain documentation for audits and inspections.
Conduct training sessions for internal teams on legal and compliance aspects.
Collaborate with business teams, external counsel, and other stakeholders.
Qualifications
Years of experience – 10 years of relevant experience in non-litigation legal activities in an NBFC with 5 Years in team handling
LLB from a reputed law school.
Required Skills
Banking laws, NBFC regulations, RBI guidelines, and SARFAESI Act.
Property laws, Contract Act, and Negotiable Instruments Act.
Recovery mechanisms and arbitration practices.
Proven comparable experience in handling legal matters with a NBFC/Bank.
Turnaround time for legal documentation and advisory.
Effectiveness in resolving pre-litigation disputes.
Compliance with regulatory and audit requirements.
Contribution to risk management and operational efficiency.
Highly analytical with strong attention to detail.
Individual contributor with proven ability to prioritise and manage tight deadlines in a fast-paced environment with high accuracy.
Must have excellent command over spoken and written English.
Preferred Skills
Experience in a similar role within the financial services sector.
Strong negotiation skills.
