Overview

Objectives - Individual is an Assistant Prosecuting Attorney. Responsible for advising clients of the Prosecuting Attorney on civil matters occurring in and affecting county government and/or township government. Advises on contracts, land use, zoning, purchasing, competitive bidding, employment law, public records, open meetings, real estate, taxation, development, procedure, construction law, election and levy law, and other issues affecting the Prosecuting Attorney’s clients.

Performs legal research, drafts opinions and memos, and litigates civil matters before state and federal courts (plaintiff and defendant). Includes prosecution of foreclosures and preparation of appellate briefs for civil actions before all levels of appellate courts, with oral argument as necessary. Represents clients before local, state, and federal administrative agencies and boards. Physical presence in the office and regular, predictable, prompt attendance are required.

Responsibilities
  • Attends meetings of county and/or township boards as appropriate to provide legal advice, including evening meetings; meetings may occur off site and outside normal hours
  • Drafts, reviews, and approves contracts as to form
  • Counsels county and township elected officials, officers, and boards on a wide range of legal and business matters, including contracts, land use, zoning, purchasing, competitive bidding, employment law, public records, open meetings, real estate, taxation, development, procedure, construction law, election and levy law, and related issues
  • Conducts electronic and book legal research
  • Drafts opinions on legal issues affecting Prosecuting Attorney clients
  • Prepares for litigation and litigates civil matters before state and federal courts on behalf of clients of the Prosecuting Attorney (prosecution and defense)
  • Represents clients before various administrative agencies and boards
  • Public speaking and education of Prosecuting Attorney clients on legal issues; presents at conferences and events
  • Advises the Prosecuting Attorney on legal matters pertaining to the Office
  • Performs other duties as assigned by the Chief of the Civil Division and/or the Prosecuting Attorney
  • Available outside normal working hours for urgent matters
Minimum Requirements / Qualifications
  • Juris Doctor (JD)
  • Admitted to the practice of law in the State of Ohio
  • Must possess a valid State of Ohio Driver's License and have an acceptable driving record

  • Researches and drafts appellate briefs and other documents for appeals of civil actions; prepares for and orally argues such appealed actions
  • Representation before administrative agencies and boards
  • Public speaking and education of clients on legal issues; represents at conferences
  • Advises the Prosecuting Attorney on legal matters pertaining to the Office
  • Other duties as assigned by leadership
  • Available outside normal working hours for urgent matters
Supplemental Information

Critical skills/expertise
:

  • Thorough knowledge of Ohio civil statutes, case law, and procedure
  • Basic knowledge of the structure of Ohio government and its political subdivisions
  • Strong trial and oral advocacy skills, including jury selection, document authentication, examination and cross-examination, and argument to bench and jury
  • Excellent legal research and writing skills
  • Excellent verbal and written communications skills
  • Ability to manage a large, complex caseload under the Prosecuting Attorney
  • Excellent interpersonal skills and ability to interact with people of varied education and backgrounds
  • Good public speaking skills

  • Ability to evaluate risks and exercise sound judgment in complex situations with major implications for Delaware County and its townships

  • Reporting

Individual reports directly to the Chief of the Civil Division, Executive Administrator and the Prosecuting Attorney. The individual exercises independent judgment with direction.

Equipment and Work Environment
