Job DescriptionWe are seeking a Subpoena Specialist to join our team. Under minimal supervision, interprets, investigates, and processes subpoenas served on the bank by attorneys, law enforcement, federal agencies, and state agencies requesting information related to criminal, civil, or other investigations. Ensures the privacy and confidentiality of bank information while adhering to applicable regulations and mitigating risk.
Responsible and accountable for managing risk by openly exchanging ideas and concerns, following established policies and procedures, and always acting in the best interest of customers and colleagues. While operating within the clients risk appetite, achieves results by identifying, assessing, managing, monitoring, and reporting risks of all types to support a positive customer experience. You will collaborate with cross-functional teams and stakeholders to deliver high-quality solutions in a fast-paced environment.
Key Responsibilities- Analyze and interpret legal language within subpoenas to determine scope, jurisdiction, timeframe, due date, and proper service, ensuring only legally requested records are released.
- Review subpoenas for potential risk or liability to the client and escalate issues in a timely and effective manner.
- Process and comply with high-profile subpoenas, including those related to Anti-Money Laundering, terrorism, criminal matters, Grand Jury proceedings, and federal requests.
- Identify and respond to federal subpoenas in compliance with the Right to Financial Privacy Act.
- Ensure complete compliance with all federal and state regulations and statutes.
- Communicate regularly and effectively with attorneys, federal and state agencies, and law enforcement personnel to negotiate scope, provide status updates, request extensions when necessary, and notify requestors when document production may exceed cost limitations.
- Coordinate and collaborate with internal and external legal counsel to support responses to third-party subpoenas.
- Provide expedited support to legal counsel on litigation matters by locating all potentially responsive documentation.
- Research, analyze, and coordinate court appearance subpoenas to determine document requirements, personnel needs, and potential risk or liability, escalating concerns when necessary.
- Maintain strict confidentiality of information to mitigate operational, reputational, monetary, and legal risk.
- Ensure prompt, accurate completion, organization, storage, integrity, and shipment of requested records in accordance with court-ordered deadlines.
- Organize and prioritize subpoena workflows by closely monitoring deadlines to minimize risk associated with missed deadlines or court appearances.
- Coordinate with other lines of business to obtain subpoenaed documentation not immediately accessible to Legal Operations.
- Research and process requests related to mortgage, installment, and commercial loan documentation; collateral files; signature cards; online banking history; wire transactions; ACH transactions; CTRs; video surveillance; fraud documentation; vendor records; and other related materials.
- Ensure all communications and transactions related to subpoenas are accurately documented in the Legal Database.
- Prepare and send invoices to requestors for copies and research time, including providing advance notice of fees and following up on outstanding balances.
- Communicate effectively with customers, requestors, and agencies on incoming and outgoing calls in accordance with applicable procedures and scripting.
- Perform legal research as needed.
