General

Job Description

Under the general supervision of the City Attorney, prepares and handles criminal prosecutions. Assists the City Attorney in representing the Cheyenne Police Department and other civil matters as assigned.

Primary Duties and Responsibilities
  • Prosecute misdemeanor cases in municipal court, including evaluation of citations filed by the Cheyenne Police Department; making charging decisions; conducting legal research; preparing and responding to discovery; drafting pleadings; negotiating case resolutions;
    Representing the City in Municipal Court and conducting both bench trials and jury trials. Respond to inquiries and provide legal advice regarding criminal law and procedure to the Mayor, City Council, City departments and various boards and commissions.
  • Provide legal advice to the Cheyenne Police Department. Including advice on public records requests, contract review, and policy and procedure within the Department.
  • Provide proactive and preventive legal advice to prevent lawsuits, claims, and other issues from arising.
  • Receive and respond to public inquiries, citizen complaints, and requests for information.
  • Perform general legal research; utilize law libraries and other research mechanisms; and keep current on relevant legal issues.
  • Respond to inquiries from courts, the District Attorney’s Office, Youth Alternatives, and other agencies.
  • Maintain compliance with licensing and continuing legal education rules of the Wyoming State Bar.

Knowledge,

Skills and Abilities
  • Operations, services, and activities of a City Attorney’s Office.
  • Relevant principles of civil, criminal, constitutional and administrative laws, codes, and regulations.
  • Federal and state criminal laws and procedure.
  • Methods and techniques of legal research.
  • Organization, duties, powers, limitations, and authority of City government.
  • Modern office procedures, methods, and equipment, including computers and applicable software applications.
  • Provide responsive, timely assistance to the City Attorney and other supervisory or management staff.
  • Prepare and prosecute criminal cases from initial intake, up to and including trial.
  • Prepare clear, concise and well-reasoned legal documents, including motions, briefs, memoranda, and legal opinions, in support of municipal prosecution and related legal matters.
  • Properly interpret and apply federal, state, and local laws, regulations and policies.
  • Communicate concisely and clearly, both orally and in writing.
  • Establish and maintain effective working relationships with those contacted in the course of work.
  • Understand and follow oral and written instructions.
Qualifications for the Job

Required:

State of Wyoming Bar

Preferred:
One (1) to five (5) years of Prosecution experience.

While performing the duties of this job, the employee is required to maintain effective audio-visual discrimination and perception needed for making observations, communicating with others, reading, and writing. The employee is also required to maintain physical condition necessary for operating assigned equipment, walking, standing, kneeling, repeated bending or sitting for prolonged periods of time and lifting to 30 pounds.

Maintain mental capacity which allows the capability of making sound decisions demonstrating intellectual capabilities.

Working Environment

Work closely with others in an office environment utilizing a computer and other office equipment. Occasional irregular working hours.
