Job Description – Environmental Analyst III – Brownfields Credit Specialist (260001H1)

Division Overview

The Office of the General Counsel advises the Commissioner and others within the department on all aspects of tax and administrative law. The Office also oversees the operations of the Underground Storage Tank Program (UST). The UST Program also provides technical assistance to other DOR divisions as required.

Job Description

Examines Brownfields Tax Credit applications, returns and other filings; verifies data through communication with the assigned Tax Examiner, the Massachusetts Department of Environmental Protection (MassDEP), and possibly the taxpayer or credit application preparer; gathers information from all available resources to ensure the net response and removal costs claimed by applicants are necessary to achieve the permanent solution or remedy operation status pursuant to G.L. 21E or whether and to what extent such costs are incurred for other purposes (i.e., construction, maintenance) as defined under G.L. c.63, § 38Q and G.L. c. 62,

§ 6(j). Coordinates findings with the assigned Tax Examiner and/or Appeals Officer assigned to the case.

Documents to be reviewed include, but are not limited to, Brownfields Tax Credit applications, DOR’s tax credit audit findings, invoices, environmental technical reports, technical correspondence from the MassDEP, technical field notes, contract documents, financial reports, laboratory analytical reports, environmental site investigation reports, human health and ecological risk assessments, geotechnical investigation reports, environmental remediation planning and design documents, architectural designs and reports, construction drawings, and as-built records.

Prepares well‑written and comprehensive reports and letters that clearly and concisely explain the basis for decisions with appropriate references to public written statements and makes recommendations to the Tax Examiner and/or Appeals Officer for qualifying expenses.

Attends environmental meetings, hearings, and training seminars as directed.

Performs other related duties as required.

Preferred Qualifications
  • Solid understanding of G.L. 21E, 310 CMR 40.0000 (the Massachusetts Contingency Plan‑MCP) including MCP‑related technical guidance documents and policies, and all of the requirements set forth under the Brownfields Tax Credit Statutes, the Brownfields Tax Credit Regulation, and associated directives including Technical Information Releases (TIRs) relative to the requirements for application of the Massachusetts Brownfields Tax Credit.
  • Experience with large/complex redevelopment/environmental remediation and construction projects.
  • Excellent writing skills—ability to write concisely, express thoughts clearly, and develop ideas in a logical sequence.
  • Excellent organizational skills—ability to prepare technical and general reports including the use of charts, graphs and tables.
  • Knowledge of MGL chapters 62, 62B, 62C, 63, 64H and 64I and applicable public written statements relating to applications for credit, other tax benefits and/or voluntary disclosure relief.
  • Ability to analyze and determine the applicability of environmental science data and correctly interpret the information presented and make appropriate decisions and recommendations.
  • Ability to give oral and written instructions in a precise, understandable manner.
  • Ability to adapt to varying work situations, including establishing and maintaining harmonious working relationships and dealing tactfully with others.
