Overview
Seeking an experienced commercial real estate attorney for the position of Real Estate Counsel for its Charlotte, NC office. The Real Estate Counsel position requires a professional who takes a thoughtful, solutions-oriented approach to issues within the company's business directives. This position will report to the company’s Vice President - Legal and provide real estate-related legal services to the company, primarily for the leasing of a portfolio of shopping centers throughout the Southeast, Midwest, and West.
This is a tremendous in-house opportunity with a growing company.
- Assist in the development and implementation of the company’s existing lease forms and
- Draft, negotiate and review commercial retail lease documents
- Review and interpret existing leases, easements and declarations to assist the leasing, outparcel development and disposition departments in those projects and activities
- Work with outparcel development department in initial reviews of real estate-related due diligence
- Draft and negotiate broker listing agreements for both purchase and sale of real estate and for commercial leasing
- Protect the company’s interests in producing non-disclosure/confidentiality agreements for sensitive financial matters
- Draw up right of entry agreements, declaration amendments and easements when needed
- Work with tenant lenders in preparing Landlord Waiver Agreements to assist tenants in obtaining financing loans while protecting the company’s interest in being able to dispose of abandoned collateral
- Draft lease amendments and review lease enforcement documentation such as notices of default and notices to quit
- Drive the continuous improvement of legal processes and functions; specifically, as those processes and functions relate to the company’s existing form leases and amendments
- Prepare reports and provide consistent updates on the status of all transactions to company executives and other departments within the company such as leasing and construction
- JD from an accredited law school
- Licensed to practice law in at least one state
- 3-7 years of real estate experience with a fair amount of focus on commercial leasing (retail preferred, but office or warehouse leasing is acceptable)
- Ability to work in a fast-paced environment and to manage and prioritize a complex workload appropriately in conjunction with other team members and departments
- Ability to work well independently or in collaboration with other departments and individuals
- Ability to identify opportunities to create and improve process systems without direction
- Must be proficient in Word (experience with Salesforce software a plus)
