The Office of Information Privacy (OIP) is seeking an experienced Privacy Counsel to provide surge capacity support on complex, sensitive, and high-priority privacy, data protection, and cybersecurity matters. The selected attorney will advise City agencies and leadership on privacy laws, emerging technologies, policy development, and compliance initiatives aligned with administration priorities.
Scope of Services & Responsibilities Legal Advice & Counsel- Provide expert legal guidance on complex privacy, data protection, and cybersecurity matters.
- Advise City agencies on federal, state, and local privacy laws and regulations.
- Conduct and review privacy impact assessments and advise on data use initiatives and technologies.
- Draft, review, and shape privacy-related policies, legislation, and citywide guidance.
- Monitor legislative and regulatory developments and brief stakeholders on implications.
- Draft, review, and negotiate legal agreements including MOUs, NDAs, data-sharing agreements, terms of service, and multi-agency data integration agreements.
- Develop policies, templates, guidance materials, and training documentation.
- Design and deliver privacy-related training programs for City agency staff.
- Represent OIP and the Chief Privacy Officer in national and international privacy organizations and working groups.
- Engage with the Mayor’s Office, City Council, and other government stakeholders on privacy matters.
- Participate in public-facing activities, including panels, publications, and media engagements as directed.
- Prepare legal briefs and provide strategic counsel to City leadership and government officials.
- Support special projects and initiatives assigned by OIP leadership.
Candidates who do not meet all mandatory requirements will not be considered.
- Experience: Minimum 12 years of legal experience
, including NYC government experience, intergovernmental affairs, or enterprise-level privacy program support. - Bar Admission: Active admission to the New York State Bar
, in good standing. - Privacy Law Expertise: Demonstrated hands-on experience with:
- U.S. privacy and data security laws (e.g., NYC Identifying Information Law, CCPA/CPRA, HIPAA, state breach notification laws, and GDPR implications for U.S. entities).
- Drafting and negotiating privacy-related agreements (MOUs, NDAs, data-sharing agreements, MSAs, terms of service).
- Developing organizational privacy policies, compliance materials, and legal guidance.
- Conducting privacy or data protection impact assessments.
- Advising on privacy implications of emerging technologies and digital services.
- Supporting enterprise or large-scale privacy programs.
- Monitoring and advising on legislative and regulatory developments.
- Proven ability to advise senior leadership and executive stakeholders.
- Strong written and verbal communication skills for legal and non-legal audiences.
- Experience collaborating with interdisciplinary teams (IT, policy, operations).
- Certification: At least one active IAPP certification (e.g., CIPP/US, CIPP/E, CIPM, CIPT, AIGP).
- Experience as an attorney within a federal, state, or local government agency
- Extensive legal counsel experience supporting government agencies
- In-house legal experience within a large, complex, or highly regulated organization.
Compensation: $110.00 per hour
