Main Purpose of JobThe main purpose of this position is to enforce and increase voluntary compliance with Maryland protective labor and employment laws, which fall under the responsibility of the Department of Labor. This position is required to have demonstrated fluency (both oral and written) in both Spanish and English to communicate with Spanish‑speaking constituents.
Position DutiesInvestigations:
Conducts investigations and examinations of potential labor standards violations in the State. Performs this function using established investigative discovery methods and evidentiary analysis, including conducting and documenting witness interviews, identifying, collecting, and analyzing relevant information, including statements, reports, payroll, and personnel policies and records, and other required documentation and evidence.
Evaluation:
Evaluates and relates facts to compliance requirements, citing applicable labor laws and regulations for the purpose of employee empowerment, preventing violations, and public education. Performs this function through direct in‑person and telephone interviews, written communications, and reviewing and analyzing documentary information and other evidence.
Adjudication:
Adjudicates labor law violations after considering investigation results, and documents findings. Provides testimony during hearings regarding decisions. Enforces decisions by issuing citations, penalties, wage orders, final wage orders, subpoenas, and other notices.
Outreach and
Education:
Provides consultation services to employers, employees, and other interested persons to improve labor law compliance in the state. Performs this function through written and oral communication, group presentations, and collaboration with employers to establish labor law compliance programs.
Communication:
Communicates orally and in writing with employers, employees, colleagues, program management, and other interested persons for the purposes of identifying and investigating potential violations, issuing enforcement documents, obtaining compliance through approved methods (such as conciliation or settlement), and addressing inquiries from members of the public.
Report Writing:
Prepares narrative reports detailing investigations and follow‑up activities.
Other Duties as Assigned:
Performs all other duties assigned.
Education:
Graduation from an accredited high school or possession of a high school equivalency certificate.
Experience:
Four years of general investigative work. Two years of the experience must have involved investigations for compliance to laws and regulations governing wages and/or employment practices.
Notes:
- 1. Candidates may substitute the possession of a Bachelor’s degree from an accredited college or university for the required years of experience.
- 2. Candidates may substitute the possession of an Associate’s degree from an accredited college or university for two years of the required general investigative work experience.
- 3. Candidates may substitute thirty (30) college credit hours from an accredited college or university for one year of the required experience not to exceed four (4) years of the required experience.
- 4. Candidates may substitute U.S. Armed Forces military service experience as a non‑commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.
