Overview
The Paralegal will assist the Legal Department with a variety of franchise matters, including enforcement of brand standards, franchisee defaults, and terminations of franchise agreements. Responsibilities will include drafting notices of non-compliance, default, and termination, drafting termination and release agreements, maintaining compliance tracking and status reports, updating the franchise relationship database, coordinating with brand operations personnel, communicating with franchisees, and other related duties.
The Paralegal will assist the Legal Department with litigation matters, including franchise litigation, commercial disputes, insurance coverage, personal injury, property damage, data privacy and employment matters. Responsibilities will include monitoring litigation progress, maintaining litigation files and status reports, preparing litigation holds, assisting with discovery, gathering and organizing documents, preparing indemnification letters, filing insurance claims, receiving and responding to legal notices and correspondence, responding to subpoenas, and working with in-house and outside counsel, and other related duties.
Functions
- Franchise Compliance System/Default and Termination Process
- Coordinates and collects information from internal departments regarding operational, financial, construction, and other franchise agreement non-compliance defaults.
- Drafts correspondence regarding non-compliance, defaults, and terminations.
- Drafts termination, settlement, and release agreements.
- Dockets applicable dates and deadlines to ensure compliance.
- Tracks open compliance issues and defaults.
- Leads monthly meetings with brand operations personnel regarding status of compliance issues.
- Litigation Management
- Monitors and assists with managing litigation matters.
- Assists with document collection and all other tasks associated with threatened and pending litigation.
- Prepares correspondence, litigation holds, status reports, subpoena responses, indemnification letters and other legal documents.
- Files insurance claims and communicates with insurance carrier.
- Legal and Administrative Responsibilities
- Assists attorneys with gathering information, tracking legal issues, and responding to internal business clients.
- Maintains and updates legal files and databases.
- Reviews and proofreads documents and correspondence.
- Assists with other legal projects as needed.
- Bachelor's Degree, Pref
- 5 years in a law firm or corporate legal department preferably as a paralegal, Pref
- Proficient in Microsoft Office Suite
- High level of attention to detail
- Understanding of legal and entity formation documents
- Ability to maintain and handle matters of confidentiality with utmost tact and diplomacy
- Writes clearly and informatively;
Edits work for spelling and grammar;
Varies writing style to meet needs;
Ability to read and accurately interpret written information - Ability to build trust and effective working relationships across various teams/groups
- Possesses a high degree of drive and ability to produce results and accomplish goals in a fast-paced, changing work environment
- Ability to prioritize, organize and manage multiple projects with sensitive deadlines and changing environment
- Knowledge of company operations, policies, and procedures
